1. Acceptance of Terms
By accessing or using Modern Art Cartel ("MAC", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
2. Description of Service
MAC is a vaulted marketplace for physical art and collectibles. We provide secure vault storage in Toronto, Ontario, Canada. Users can buy, sell, and trade ownership of vaulted items digitally without physical shipping unless requested.
3. User Accounts
You must create an account to access certain features. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized access
4. Fees and Payments
Our fee structure is as follows:
- Buyer Service Fee: 6% of purchase price
- Seller Fee: 0% (free to list and sell)
- Artist Royalty: 5% on secondary sales
- Vault Storage: Free, forever
5. Vault Storage
Items purchased or consigned through MAC are stored in our secure vault facilities in Toronto. We maintain insurance coverage for all vaulted items. Physical redemption (pickup or shipping) is available upon request and may incur additional fees for handling, shipping, and insurance.
6. Prohibited Activities
You agree not to:
- Use the platform for any illegal purpose
- List counterfeit, stolen, or misrepresented items
- Manipulate prices or engage in fraudulent transactions
- Attempt to circumvent platform fees
- Harass or abuse other users
7. Intellectual Property
All content on MAC, including logos, design, and text, is our property or licensed to us. Sellers retain rights to their artwork images for listing purposes. You may not reproduce or distribute our content without permission.
8. Limitation of Liability
MAC provides the platform "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our liability is limited to the fees paid to us in the 12 months preceding any claim.
9. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts of Toronto, Ontario.
10. Changes to Terms
We may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of material changes via email or platform notification.
